The Role of Social Media in a Legal Dispute: A Case Study of Unethical Behavior in the Judiciary Bureau

Source from 灼见名家

On April 13, Xu Menghua, a woman from Dancheng County, Zhoukou City, Henan Province, posted a public accusation on social media that she was owed money by Aquin (pseudonym), an employee of the local judicial bureau. Xu claimed that Aquin was also having an inappropriate affair with her husband, Liu Junjie. The two parties disagreed on whether there was an improper relationship between Aquin and Liu Junjie. Still, the fact that Liu Junjie borrowed roughly CNY 800,000 from Aquin from 2018 to 2022, along with Aquin’s gambling activities, was not in dispute, according to news obtained by Upstream News.

Liu Junjie admitted to having an affair with Aquin, but he stated that he was afraid his wife would find out and therefore deleted most of the messages with Aquin. Liu Junjie didn’t have any other evidence to show there was an inappropriate affair between him and Aquin. Nonetheless, he produced a WeChat record which showed that he had transferred CNY 19,999 to Aquin. Aquin, in turn, responded, “How shall I express my joy? Thank you for the flying kiss,” to which Liu Junjie replied, “It’s OK, I’m just happy.” Then Aquin responded, “You’re awesome, cool, and handsome.” Xu Menghua, Liu Junjie’s wife, claimed that Aquin repeatedly failed to repay the loan and that she had filed a lawsuit against her.

The case ignited widespread attention from the public as it exposed a conflict within the judiciary bureau, particularly the unethical behaviour of its staff members towards private individuals. However, it raises several questions regarding the use of social media and the role that such platforms have in public discourse, particularly in cases when the line between private and public is blurred.

Xu sought to expose Aquin’s actions on social media to “vindicate her rights.” However, it’s well-known that social media is not the ideal place to resolve disputes, particularly accusations of this nature. The court, which is the proper vehicle for settling such disputes, was neglected, while social media was used to address such a matter of sensitive nature. Besides, the limited evidence provided by the parties involved would hardly stand up in court.

This incident provides a valuable lesson for the public and the government regarding the appropriate use of social media. Social media has been extensively used as a mass communication tool to expose sensitive and controversial issues that regular media outlets cannot cover. However, it includes the legal system, which remains the best way to handle the case.

China's Labour Law and the Impact of Employee Misconduct on Employment Contracts: A Case Study

Source from 凤凰网

Introduction:

The issue of employee misconduct in the workplace is one that often arises in the corporate world. While companies have the right to dismiss employees who violate company policies, it is essential to determine whether such conduct is a breach of the employment contract. This article explores the case of a Chinese employee who was dismissed from his job after being arrested for soliciting prostitution while on duty. We will examine the legal implications of the company's actions, the relevant sections of China's labour law, and the lessons that can be learned from this case.

The Facts of the Case:

In January 2021, Mr Duan signed a labour contract with a property management company in Beijing. On 2 June 2021, during working hours, he was arrested by the police for soliciting prostitution. In September of the same year, the company sent Mr Duan a termination notice stating that his employment contract had been terminated. Mr Duan argued that he had asked for leave from the company on the day of the incident and that the termination was illegal. He, therefore, took the matter to arbitration, asking to be reinstated. The company countered that Mr Duan's behaviour constituted a severe violation of labour discipline and that his termination was lawful.

The arbitration commission ruled in favour of Mr Duan, ordering the company to reinstate him. The company disagreed with the decision and took the matter to court, while Mr Duan did not file a lawsuit. In court, Mr Duan admitted that he had solicited prostitution during working hours but claimed that he had asked his deputy team leader to leave work to give his mother the keys to his apartment. The company argued that Mr Duan's leave request was not made in writing and that he had violated the company's policies.

The court determined that Mr Duan had solicited prostitution during working hours, a severe violation of labour discipline. However, the court also found that Mr Duan had verbally requested leave from his deputy team leader to go home to give his mother the keys to his apartment. Therefore, the court ruled that the company's termination of Mr Duan's employment contract was unlawful and ordered him to be reinstated.

Analysis:

China's Labour Law contains provisions relating to employers' termination of employment contracts. According to Article 25 of the Labour Law, an employer may terminate an employee's agreement if the employee has violated labour discipline or the employer's rules and regulations. However, the violation must be severe for an employer to agree. Additionally, employers must adhere to the procedures set out in the law when terminating an employee's contract.

In this case, Mr Duan's conduct seriously violated labour discipline. However, the court found that Mr Duan had verbally requested leave from his deputy team leader before leaving to give his mother the keys to his apartment. Although the company argued that Mr Duan's leave request was not in writing, the court ruled that Mr Duan's demand was sufficient. Therefore, the company's termination of Mr Duan's employment contract was unlawful, and he was ordered to be reinstated.

Lesson Learned:

From this case, it is clear that employers must adhere to the procedures set out in China's labour law when terminating an employee's contract. Employers must also ensure that the violation committed by the employee is severe enough to warrant termination. Additionally, employers must ensure that they have evidence to prove that the employee's conduct breaches the employment contract.

Employees, on the other hand, must adhere to their employer's policies and regulations. They must also ensure they follow the procedures in their employment contract when taking leave. Verbal requests for withdrawal may be acceptable.

China's Real-Time Traffic Light Display on Navigation Apps: The Technology Behind It

The world of technology always amazes us with its continuous innovations and advancements. One such innovative feature recently added to the navigation apps in China is the real-time display of traffic light status. This feature displays the current status of the traffic light and shows the countdown to the following light change, making it easier for drivers to plan their driving accordingly. This feature has left many users wondering about the technology behind it. This article explores the different possibilities that could have led to the development of this feature.

The Mysterious Technology Behind the Real-Time Traffic Light Display

Many speculations exist about the technology behind navigation apps' real-time traffic light display. Some people believe that it is based on big data analytics, where the app calculates the location, speed, and driving conditions of the vehicles to predict the status of the traffic light. This approach is said to become more accurate as vehicles increase. However, the accuracy may decrease in rural areas with fewer vehicles.

Others speculate that the technology uses the Beidou Navigation Satellite System to synchronize the light traffic timings with the satellite time. This would require the traffic control system to be connected to the satellite system, which seems highly unlikely.

Another possibility is that the navigation app companies manually collect data on the traffic lights' behaviour at different intersections and add this information to their app. Given a large number of traffic lights in China, this approach would be highly inefficient.

Finally, some believe that the traffic lights communicate with each other through wireless signals, and the navigation apps read these signals to display the traffic light status on the phone.

After researching online, it is clear there is yet to be a definitive answer to the technology behind this feature. The app developers are intentionally vague about how they implement the technology to create an air of mystery around it, which can help market the part to the public. However, some information has surfaced on how this feature works.

The Technology Revealed: Connection to Traffic Signal Information Platform

While the app developers need to be more specific about the technology, the real-time traffic light display technology is more mysterious than it seems. The most likely explanation is that the navigation apps are connected to the Traffic Signal Information Platform operated by the traffic control department.

For example, in a joint venture between the Shandong Yantai Traffic Police and the navigation app X-Map, the app reads and collates the data from 235 intersections' traffic signals to provide drivers with real-time traffic light information. Therefore, the app can accurately display the traffic light status based on the data obtained from the traffic control department.

The traffic signal information platform is only available at some intersections. Some hubs will need real-time traffic light information. However, this feature is still impressive, given that the app can display the traffic light status by connecting to the traffic control department's signal information platform.

The Truth Behind the Mysterious Technology: A Marketing Ploy

The marketing tactics used to promote the real-time traffic light display feature have led the public to believe that it is a high-tech, mysterious feature that is difficult to implement. However, the reality is that the quality is relatively simple and easy to implement, given the traffic control department's traffic signal information platform.

The language the app developers use to promote the feature, such as "predicting" the traffic light's behaviour, is misleading. The app developers use such language to make the part sound sophisticated and high-tech. Still, the quality is based on the data provided by the traffic control department.
